Terms & Conditions – Reference Photo Packs

These Terms & Conditions govern the purchase and use of digital artist reference photo packs created and sold by Nikita Gordijn, a business registered in the Netherlands. By purchasing a photo pack, you accept the terms below in full.

All services and agreements are subject to the laws of the Netherlands.

2. Product Description & Delivery

Each pose pack includes 24 high-resolution JPG images (minimum 4000px, 300 DPI) of a single artistic pose, photographed every 15° to provide a complete 360° view.
Files are delivered in a ZIP folder via email within 48–72 hours after purchase.

3. No Right of Withdrawal (Digital Content)

As per Article 6:230p of the Dutch Civil Code, the statutory right of withdrawal does not apply to digital content once delivery has begun with the buyer’s consent. By completing your purchase, you agree to immediate delivery and waive your right of withdrawal.

4. Refund Policy

Due to the nature of digital downloads, no refunds or exchanges are provided. Please ensure you review the product description carefully before purchase.

5. Usage Rights – License Agreement

By purchasing, you receive a non-exclusive, non-transferable license to use the images as reference for creating your own original artworks. This includes:

  • Drawing, painting, sketching, sculpting, digital art

  • 3D modeling, game design, or texture creation (only if the photo is significantly transformed)

  • Use in educational materials or tutorials, provided the raw image is not shared

You may not:

  • Resell, share, gift, or redistribute the original image files

  • Use the images for AI dataset training, NFT projects, or stock platforms

  • Publish the unedited photos in any commercial or promotional content

6. Exclusivity Option

Photo packs are sold non-exclusively by default. For an additional fee, you may purchase full exclusivity, which guarantees that the selected Photo pose will not be sold to anyone else after your purchase.

7. Credit Requirement

When sharing, publishing, or selling artwork created using these photos, please include the credit:
“Reference by Nikita Gordijn”
This applies to exhibitions, social media, online stores, or art education.

8. Legal Notice

All image rights remain the property of Nikita Gordijn. Unauthorized use, reproduction, or distribution of the original files is a violation of copyright law.

9. Jurisdiction

These terms are governed by Dutch law and disputes will be brought before the competent Dutch court. If you are a consumer resident in the European Union, this does not take away your right to bring proceedings in the courts of your own country, or the protection of the mandatory consumer law that applies there.

10. Acceptance

By booking and paying for your reference pack, you confirm that you have read, understood, and agreed to these Terms & Conditions.
